Nicole Richie sentenced, fined for DUI

By LINDA DEUTSCH, AP Special Correspondent

GLENDALE, Calif. - Nicole Richie pleaded guilty Friday to driving under the influence of drugs and was sentenced to about four days in jail and fined by a court commissioner who said she was lucky nobody was killed when she drove the wrong way on a freeway.
Richie, the 25-year-old daughter of pop singer Lionel Richie, was subdued and somber as she was lectured about her driving. She entered court on the arm of boyfriend Joel Madden.
Richie, who's rumored to be pregnant but has not confirmed it, wore a loose-fitting, knee-length black dress and spiked heels. She stood before the judge and softly answered "guilty" when asked how she pleaded to the misdemeanor charge. She initially pleaded not guilty in February.
She nodded when asked if she understood terms of the plea agreement (including 90 hours in jail and a fine of $2,048) worked out between her lawyers and prosecutors. Superior Court Commissioner Steven K. Lubell also gave Richie three years of probation and warned that she would go to county jail for a year if she violates it.
She must complete her sentence by Sept. 28. She can serve it in either a city or a county jail.
She was ordered to enroll in a drug and alcohol program and must prove that she has completed it when she returns to court on Feb. 20, 2008.
"You are not to drive with any measurable amount of alcohol or drugs in your system," Lubell told her. "You are not to drive without a driver's license."
He said the state Department of Motor Vehicles would decide whether to suspend her license.
"You are very lucky that no one was hurt of killed as the result of this incident," Lubell said.
Richie was arrested early on Dec. 11 after witnesses reported seeing her black Mercedes-Benz sport utility vehicle headed the wrong way on a freeway in Burbank.
The California Highway Patrol said they found her parked in the car pool lane.
Richie told authorities she had smoked marijuana and taken the prescription painkiller Vicodin, a CHP officer said at the time.
No drugs were found on her or in the car.
Lubell warned Richie of the dangers of driving under the influence and said: "The facts of this case, as the court knows it, is pretty scary. Someone could have gotten killed or injured. The court does not want anything to happen to you.
"If you continue to drive while under the influence of drugs or alcohol and someone gets killed, you can be charged with murder, not manslaughter.
"I hope that never, ever happens."
He said such a murder charge would come under a specific legal provision because she now has two convictions, the first one in June 2003 when she was convicted for driving under the influence of alcohol. The 2003 conviction made her eligible for a sentence of 90 days to a year in jail.
The reality TV star's lawyer, Shawn Chapman Holly, acknowledged to the court that the plea bargain reached with the prosecution was acceptable.
Richie made no comment to reporters as she left the courthouse, surrounded by private bodyguards.
Richie's jail sentence follows that of Paris Hilton, her co-star on the reality TV show "The Simple Life."
Hilton recently was released after spending about 23 days in custody for violating probation in an alcohol-related reckless driving case.

The Space Shuttle Astroanuts? DRUNK????? Houston, we have a drinking problem!

By MARCIA DUNN, AP Aerospace Writer

CAPE CANAVERAL, Fla. - At least twice, astronauts were allowed to fly after flight surgeons and other astronauts warned they were so drunk they posed a flight-safety risk, an aviation weekly reported Thursday, citing a special panel studying astronaut health.
The independent panel also found "heavy use of alcohol" before launch that was within the standard 12-hour "bottle-to-throttle" rule, according to Aviation Week & Space Technology, which reported the finding on its Web site.
A NASA official confirmed that the health report contains claims of alcohol use by astronauts before launch, but said the information is based on anonymous interviews and is unsubstantiated. The official didn't want to be named because NASA plans a news conference Friday to discuss the panel's findings.
The panel was created following the arrest in February of former space shuttle flier Lisa Nowak, who was implicated in a love triangle.
NASA's space operations chief, Bill Gerstenmaier, said Thursday it would be inappropriate for him to discuss the matter before the report is released on Friday.
Asked if he had ever personally had to deal with a safety issue involving an inebriated astronaut in space, Gerstenmaier replied: "The obvious answer is no. I've never had any instances of that.
"There's not been a disciplinary action or anything I've been involved with regarding this type of activity," he said.
In Washington, the chairman of the House Science and Technology committee said he hadn't seen the report, "but if the reports of drunken astronauts being allowed to fly prove to be true, I think the agency will have a lot of explaining to do."
"That's not the 'right stuff' as far as I'm concerned," said Bart Gordon, D-Tenn.
The Aviation Week report doesn't make clear when the alleged incidents occurred, nor does it say whether the intoxication involved crew members who have no role in flying the shuttle or whether it was the pilot and commander.
NASA plans to release findings of a pair of reviews — one by the outside committee and the other by an internal panel — into astronauts' health Friday.
The independent panel's NASA consultant and its eight members, which include Air Force experts in aerospace medicine and clinical psychiatry, did not immediately return phone messages or e-mails from the Associated Press Thursday afternoon.
Aviation Week said the report citing drunkenness does not deal directly with Nowak or mention any other astronaut by name.
Nowak is accused of attacking the girlfriend of a fellow astronaut — her romantic rival — with pepper spray in a parking lot at Orlando International Airport. Fired by NASA in March, she has pleaded not guilty to charges of attempted kidnapping, battery and burglary with assault.

Kelly Clarkson's Marijuana Cookie Experiment

Must we have to read these madness??? Friday the 13th is already scary!

FRIDAY JULY 13, 2007 03:00 PM EDT
By Brian Orloff

As the saying goes, "When in Rome . . ." Well, when in Amsterdam, Kelly Clarkson partook in a (legal) local activity: She ate a marijuana cookie. "It was in Amsterdam," the singer, 25, tells USA Weekend magazine in a new interview. "It is legal there, and it is not legal here. I don't ever do anything illegal here." Clarkson adds: "I have never smoked anything in my life. I've never tried any drugs. I wouldn't do anything that would cause holes in your brain or your nasal cavity. Call me Texan, but I don't think of marijuana like that." Ever since the Amsterdam experiment the singer says she's been "oregano-free." Similarly candid during the chat, Clarkson opens up about the tumultuous times that inspired her new record My December, its unfavorable response at her label and her body image. Of the latter, Clarkson explains, "I have never been to a point where I have been so unhappy that I have said to myself: 'Oh God, you are fat!' I don't allow myself to go there." Still, Clarkson admits to feeling a lot of pressure while writing My December, inspired by a breakup – her boyfriend was cheating on her, she reveals – and the stress of a long tour plagued by illness. "Everything caught up with me in a bad way," she tells USA Weekend. "My body was wearing down, and my emotions were wearing down." Life became worse for Clarkson, she says, when she submitted her album to her label RCA in January and earned, well, not the response she expected. She has already spoken publicly about her disagreements with label head Clive Davis. But as she tells it in the new interview: "I'm going to be real honest with you: I am not a fan [of Davis]...I do respect him, but I don't want to barbecue with him. We don't braid each other's hair. And, despite the rumors, he is nowhere near a father figure." Despite darker moments in her life though – and her recent career hiccups including the firing of her longtime manager and cancellation of her summer tour – Clarkson still feels confident and comfortable with her position. "I used to live paycheck to paycheck," she says in the interview. "Now I am set for life."

New DUI Trial Delay for Nicole Richie

WEDNESDAY JULY 11, 2007 12:50 PM EDT
By Ken Lee

Nichole Richie was granted another trial delay in a Glendale, Calif. courtroom Wednesday. Her lawyer, Shawn Chapman Holley, appeared on behalf of Richie, arguing that the case should be delayed because a key drug-expert witness had been traveling abroad and was unavailable for trial, which was scheduled to begin today. "Dr. Terence McGee is going to challenge the prosecution's scientific evidence," Holley said. "Observations were made of Ms. Richie that he can [refute]." Holley also stated that a urine analysis taken the night of Richie's Dec. 11 arrest was "unreliable." Los Angeles County Commissioner Steven Lubell granted the new delay, and ordered Richie to show for trial on Aug. 16. Holley apparently turned down any plea deal – for now – that an L.A. Superior Court spokesman confirmed was offered to Richie. Details of that plea deal were not disclosed. If convicted of the misdemeanor charge, the Simple Life star – who has pleaded not guilty – faces a minimum sentence of four days in jail with three years of probation because it would be her second DUI offense. Last month Richie, 25, told David Letterman on his show that she is "scared" to go to jail. But, she added, "I'm willing to face whatever consequences come my way, and I take responsibility for what I've done." Spotted driving the wrong way on a Los Angeles freeway last December, Richie failed a field sobriety test and admitted to police that she'd smoked marijuana and taken Vicodin earlier that evening. She was previously convicted of a DUI in June 2003. Although California law states that repeat DUI offenders get a minimum three months in jail, that sentence can be reduced to only four days if the person accepts a three-year probation term.

McNair's DUI case dismissed. (Let's hope it does not repeat itself)

Nashville, Tenn. // The Ravens scored their first victory of the season, 19 days before the start of training camp. Ravens quarterback Steve McNair had his drunken driving-related charge dropped today, which virtually eliminates him from any discipline from the NFL.
McNair's charge -- which is commonly referred to as "driving under the influence by consent" -- was dismissed at the Nashville criminal court after his brother-in-law, Jamie Cartwright, had his DUI charge reduced to reckless driving."I'm glad it's over," McNair said while leaving the courtroom. "That's all that matters."Dressed in a black suit and gray shirt, McNair declined any further comment and did not answer a question whether this latest incident would change his lifestyle.McNair was arrested May 9 on the little-known Tennessee misdemeanor offense that prohibits a vehicle owner from letting the vehicle be driven by someone who is inebriated.Cartwright was driving McNair's Dodge pickup when police stopped it for allegedly going 45 mph in a 35-mph zone. He was charged with drunken driving after failing a field sobriety test and refusing to take a Breathalyzer test, according to police. As part of his plea bargain agreement, Cartwright will serve two days in jail within a month, pay a $350 fine and attend DUI school."It was a good resolution for all sides," said Ed Ryan, the lawyer for Cartwright.Once Cartwright reached the settlement, assistant district attorney Michel Claire Bottoms announced that the state had to dismiss McNair's charge because there was no longer any DUI.Seated in the third row of the courtroom, McNair flashed a small grin when the charge was officially dropped. In a statement released later by the Ravens, McNair said, "I said before that I thought I did the right thing that night, and the court process had to play out. I've been getting ready for the start of training camp, and I'm ready to go. I'm looking forward to getting back on the field with my teammates and coaches. Right now, I'm going to take a little vacation with my family."This was the same agreement that had been in place since the first pre-trial conference on May 30, but prosecutors decided to delay the case 41 days for further review.NFL spokesman Greg Aiello said the league would have to review the case but he did not expect McNair to face any league discipline."This is good news and what we expected," said Kevin Byrne, the Ravens' senior vice president of public relations.McNair, who looked to be in good shape, will begin his second season as the Ravens' starting quarterback when the team reports to training camp on July 29.Last season, McNair led the Ravens to a 13-3 record and the AFC North title, throwing for 3,050 yards and 16 touchdowns."He's a good individual," said Roger May, McNair's lawyer. "He tried to do what he thought was the right thing in this situation without knowing it was in violation of Tennessee law."This is the second time that McNair has had a case dropped. In May 2003, McNair was arrested in Nashville on charges of driving under the influence and illegal gun possession. The charges were dismissed after a judge threw out the evidence, stating police did not have sufficient reason to pull him over.

MTV's Jessica Smith pleads guilty to DUI

SANTA ANA, Calif. — Jessica Smith a former cast member of MTV's "Laguna Beach: The Real Orange County," received three years probation after pleading guilty to a misdemeanor drunken driving charge, prosecutors said Thursday.
Smith's attorney entered the plea on her behalf Monday without her appearing, said Orange County district attorney's spokeswoman Susan Schroeder.
She was also ordered to perform 80 hours of community service and pay $1,300 in fines and penalties.

Smith, 19, was arrested in March for investigation of felony driving under the influence of alcohol after crashing a Volkswagen Beetle into another car on the San Diego Freeway, according to a California Highway Patrol report.
The driver of the other car suffered minor injuries as did a passenger in the car driven by Smith, the report said.
Although Smith was arrested for investigation of felony DUI, the charge was lessened to a misdemeanor because the injuries were not serious, officials said.

Mel Gibson and the Tequilla!

Mel Gibson tools down Pacific Coast Highway at 87 mph with a bottle of tequila in his Lexus last year before he’s pulled over. After an angry, anti-Semitic rant in which he blames Jews for all the world’s wars, he’s taken to jail for drunken driving.

Paris Hilton and the DUI/Prison case finally over.....for now.

LOS ANGELES -Paris Hilton promised to become a better person when she got out of jail. The more important issue, though, may be whether she can be a better driver. "I will never drink and drive again,” Paris Hilton pledged on “Larry King Live” after she got out of jail. In Hollywood, history shows that would be a tough act to follow. Will the hotel heiress have the good sense to hand her keys to someone else after a night of club-hopping, or risk another stay at the gray-bar hotel?

In Memory of all killed in the hands of IMPAIRED DRIVERS!

This blog is dedicated to Oyeleke my 17 year old brother who loved the internet so much, (an IT major at Bournville College, Birminham, UK) so much and was waiting to see what happens at the arrival of Y2K. Sadly he died while struck on December 21st 1999 by a drunk driver who cut a red light in Birmingham, England right in front of his college dorm.I will EXPOSE celebrities by the day as our kids look up to them! As a pharmacist, it is relevant we educate the public about the dangers of these substances. Many have gotten killed "accidentally" even without being on the wheels and I'm not condeming them but this blog is just to inform the public of imminent dangers and education for your family.
